- In the event of non-conformity of the Product with the concluded Sales Agreement, the Consumer has the rights specified in the Consumer Rights Act.
- The Seller is liable for the lack of conformity of the Product with the Sales Agreement existing at the time of its delivery and disclosed within two years from that moment.
- When filing a complaint, the Buyer may request that the seller exchange the purchased goods for a defect-free item or remove the defect.
- The Buyer also has the right to demand a price reduction unless the Seller immediately and without excessive inconvenience to the Buyer replaces the defective item with a defect-free one or removes the defect.
- The Seller may make a replacement when the Consumer requests a repair, or the Seller may make a repair when the Consumer requests a replacement, if bringing the Product into compliance with the Sales Agreement in the manner chosen by the Consumer is impossible or would require excessive costs for the Seller.
- If repair and replacement are impossible or would require excessive costs for the Seller, the Seller may refuse to bring the Product into compliance with the Sales Agreement.
- If the defect is deemed to be significant or if the Buyer files another complaint about previously repaired or replaced goods, the Buyer has the right to withdraw from the concluded agreement.
- The Buyer may not withdraw from the agreement if the defect is insignificant. The complaint should include the following data:
- name and surname
- mailing address, e-mail address and phone number
- subject of the complaint
- reason for the complaint
- consent to the processing of personal data
- signature (handwritten signature in the case of a complaint submitted by post)
- The product being complained about must be clean - washed, and also "smell-free" e.g. creams, perfumes, sweat
9. The Seller is not responsible for defects in goods resulting from improper use or storage of goods and failure to follow the instructions attached to the goods.
10. Complaints regarding goods without markings, in particular labels or inserts, will not be accepted for consideration.
11. Complaints are not subject to:
- natural wear and tear of the product,
- mechanical damage,
- obvious defects visible at the time of receipt of the package, and not reported immediately after their discovery,
- discoloration,
- defects resulting from a method of washing that is inconsistent with the instructions. The seller is liable for physical or legal defects of the goods sold only if the defects are discovered before the expiry of two years from the date of receipt of the goods by the buyer.
12. Complaints will be considered by the seller immediately from the date of their receipt, no later than 14 days from the date of their receipt.
13. The seller will inform the buyer about the result of the complaint to the e-mail address indicated in the complaint notification, and in the case of correspondence by letter - to the address indicated by the buyer.
14. If the complaint is accepted, the seller undertakes to agree on the date and method of replacement of the item that is the subject of the complaint.
The seller informs that he agrees to the resolution of consumer disputes in the mode of the Act of 23 September 2016 on the out-of-court resolution of consumer disputes (Journal of Laws 2016, item 1823). If the complaint is not accepted by the seller, the consumer may use out-of-court methods of complaint resolution and claim settlement and request intervention from the Voivodeship Inspectorate of Trade Inspection in Krakow, ul. Ujastek 1, 31-752 Kraków, www.krakow.wiih.gov.pl. Detailed procedures for using the help of the Trade Inspection are available on the website of the office and on the website www.uokik.gov.pl in the tabs "resolution of consumer disputes" and "important addresses". Extrajudicial redress after the complaint procedure is completed is free of charge. In the case of a buyer who is a consumer who wants to use an extrajudicial method of redress, there is also the possibility of filing a complaint via the EU online platform odr, available at http://ec.europa.eu/consumers/odr/ .
